These are the terms and conditions which apply to your use of The Yoga Tree website (the “Website”) and The Yoga Tree Mobile Application (the “App”), and the purchase of Goods and Services from us. Please read these Conditions carefully before using this Website, the App, or purchasing any Goods or Services from us. If you do not agree to these Conditions, you must not use this Website or our App.
Liability Waiver
I understand that yoga includes physical movements as well as an opportunity for relaxation, stress reduction and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated.
Medical Release: Yoga is not a substitute for medical attention, examination, diagnosis, or treatment. Yoga is not recommended and is not safe under certain medical conditions. By signing, I affirm that a licensed physician has verified my good health and physical condition to participate in such a fitness program.
COVID-19: I will make the instructor aware of any medical conditions or physical limitations before class. I agree I will not participate in any in-studio or outdoor classes if I have flu-like symptoms and/or a fever or I have been diagnosed with COVID-19 within the past 14 days or I have been in close proximity with a person with COVID-19 within the past 14 days.
I understand that airborne viruses may be present at The Yoga Tree LLC, and I agree that I will not hold The Yoga Tree LLC, its owners, and/or instructors liable for any illnesses that may be contracted by visiting the studio and being in near proximity with others. I also acknowledge that cleaning agents are used and will not hold any of the persons referenced in the preceding sentence for any allergic reactions to airborne remnants of cleaner within the studio.
Pregnancy: If I am pregnant, become pregnant or I am post-natal or post-surgical, my signature verifies that I have my physician’s approval to participate.
Virtual + Outdoor Classes: I understand that this Waiver and Release applies to virtual and outdoor classes and that I will not hold the property owner, The Yoga Tree LLC, or its instructors liable for any injuries sustained.
I affirm that my participation in yoga is at my own risk, and I hereby agree to irrevocably release and waive any claims that I may have had, now have, or may have hereafter against The Yoga Tree LLC, its owners and instructors. I also affirm that I am solely responsible for the security of my own belongings.
I have read fully and understand and agree to the above terms of this Waiver and Release. I am signing this agreement voluntarily and recognize that my signature serves as a complete and unconditional release of all liability to the greatest extent allowed by law in the State of Massachusetts.
Class Passes
To book a class, your account must include at least one class pass. One class pass entitles you to attend one class. You can purchase class passes via our Website or App. Multiple classes can also be purchased as packages at discounted rates. Price details for classes are available on our Website or App and shall be determined by The Yoga Tree.
You should be aware that class passes expire, and future prices are subject to change. Subject to any statutory right of cancellation, payments for classes are non-refundable unless otherwise stated in these Conditions. Expiration dates are fixed and will not be extended for any reason, no exceptions.
Unlimited Memberships
Your first-month fee is due upon execution of this Agreement. Thereafter, monthly fees are due on the same day of each subsequent month. Fees must be paid automatically by a debit card or credit card. By providing your debit card or credit card information, You are consenting to The Yoga Tree automatically withdrawing your fees as they come due each month. Your fee shall be based on the specific membership. The current fees for these memberships are set forth on our Website and App. The Yoga Tree reserves the right to adjust its membership fees at any time during the term of this Agreement.
Gift Cards
Gift cards are available for purchase in the studio and on our website/app. E-Gift Cards can be purchased on our website/app and will be sent via email to the recipient. If you would like to purchase a physical Gift Card, please visit us in the studio or give us a call.
PLEASE NOTE: All Gift Cards hold the same expiration dates as our class credits and are stated at checkout.
Cancellations
In order to cancel a reservation in a The Yoga Tree class and return it to your account, you must cancel no later than 8 hours before the start of class. Once your reservation is canceled, the class will be returned to your account to be used at a future date. If you fail to cancel within our cancellation window, the class is not refunded. Late cancellations result in the loss of Class Pass for package holders. If you are on an unlimited membership and do not cancel within the cancellation window, you will receive a $10 late cancellation fee.
You can cancel your reservation by logging into your account on the Website or the App, and, next to the class you wish to cancel, press “unreserve”
Waitlists
When you join the waitlist, one Class Pass will be deducted from your account. If you join the waitlist and a space becomes available, you will be automatically added to the Class. You will be notified by e-mail if you are automatically added to a Class.
If you join a waitlist but no longer wish to attend the Class, you should cancel the booking via our Website or App as soon as possible. If you are added to a Class you may cancel up to 8 hours before the start of class and receive a refund of your Credit but you will not be refunded if you cancel after the 8 hour cancellation window.
If you join the waitlist and a place on the fully booked Class does not become available by the start of Class, the Credit debited from your account to join the waitlist will be returned to your series. If we cancel a class, your Credit will be returned to your series.
Lateness
Parking in downtown Haverhill can tricky at times and we ask that you plan ahead and provide yourself with ample time to arrive. If you’re running late, don’t stress! We simply ask that you call or text the studio to let us know you are on the way. If you notify the studio, we will hold a reservation for you.
If you do not notify the studio that you are running late, The Yoga Tree reserves the right to open up your reservation to walk-in students. If you have already notified the studio that you are running late, we ask that you enter the studio quietly upon your arrival so as not to disturb other students.
Minimum Age Requirement
We require that all yogis be at least 16 years of age to attend our public classes, no exceptions.
Personal Items + Cell Phones
We kindly ask that you leave all personal items in the lobby, including shoes, purses, backpacks, etc.
Cell phones are not allowed in the studio. If it is necessary to have your phone with you, you may leave it in the designated area in the lobby. Please make sure it is on silent mode before class begins. The yoga practice is about connecting with yourself and your community, not your devices.
Refunds
All purchases including but not limited to class passes, memberships, special events, retail and apparel are non-refundable, no exceptions.
In the event that you cannot attend a workshop, your registration can be transferred to a friend or family member, if the studio is notified via email at least 24 hours before scheduled event. Please email info@theyogatreestudio.com if you would like to transfer your registration to someone else.
Code of Conduct
The Yoga Tree is committed to the health, safety, and welfare of all of its members and staff and will not tolerate threatening, obscene, harassing, indecent, or illegal behavior. Engaging in such activity shall be grounds for immediate termination of this Agreement.
